DMCA Copyright Policy

FEAIA respects intellectual property rights and processes copyright infringement notices pursuant to the Digital Millennium Copyright Act (DMCA). This policy explains the notice and counter-notice procedures.

§1 Overview

Pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512), FEAIA has designated a copyright agent to receive infringement notifications. As a qualifying service provider, we will take appropriate action upon receipt of a valid DMCA notice.

This policy also reflects our respect for copyright laws worldwide, including but not limited to the EU Copyright Directive and the PRC Copyright Law.

FEAIA is a software tool provider and does not host user-generated media content. If you believe the FEAIA software itself is infringing, please submit a notice following the procedure below.

§2 DMCA Takedown Notice

If you believe your copyrighted work has been infringed, please submit a written notice (email is acceptable) to our designated copyright agent.

Process after notice submission:

If applicable, notify the alleged infringer of their counter-notice rights

§3 Required Elements

A valid DMCA notice must include all of the following elements (per 17 U.S.C. § 512(c)(3)):

1. Copyright owner identity:Signature of the copyright owner or authorized agent (electronic signature accepted)
2. Infringed work:Description or link to the copyrighted work claimed to be infringed
3. Infringing content location:Specific location of the allegedly infringing content on our service (URL or equivalent)
4. Contact information:Your address, phone number, and email address
5. Good faith statement:A statement that you have a good faith belief that use of the content is not authorized by the copyright owner, its agent, or the law
6. Accuracy statement:A statement that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf (under penalty of perjury)
Notices that do not comply with the above requirements will be treated as invalid and we may be unable to act on them.

§4 Counter-Notice Procedure

If you believe your content was removed in error, you may submit a counter-notice. A valid counter-notice must include:

  • Your signature (electronic accepted)
  • Identification of the removed content and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the content was removed due to mistake or misidentification
  • Your name, address, phone number, and email address
  • Consent to the jurisdiction of the federal district court (if in the US) or other appropriate jurisdiction

Upon receipt of a valid counter-notice, we will forward a copy to the original complainant within 10–14 business days and restore the removed content after that period (absent a court order).

§5 Repeat Infringer Policy

As required by DMCA § 512(i), FEAIA maintains a policy of terminating accounts of repeat infringers.

Upon receiving multiple valid infringement notices against the same user:

  • First valid notice: Warning and removal of infringing content
  • Second valid notice: Account suspension and review
  • Third valid notice: Permanent account termination

Notices resolved by successful counter-notice do not count toward the above. We reserve the right to immediately terminate accounts for egregious infringement.

§6 False Claims Warning

Under DMCA § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, is liable for damages including attorneys' fees. Submitting a false DMCA notice is a serious legal act — please ensure all statements are truthful and accurate.

Before submitting a notice, please confirm: (a) you are the copyright owner or their authorized agent; (b) you have substantial reason to believe the identified content infringes your copyright; (c) all statements in the notice are true.
